AN ACT
Amending Title 27 (Environmental Resources) of the Pennsylvania
Consolidated Statutes, providing for water obstruction and
encroachment permits.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 27 of the Pennsylvania Consolidated
Statutes is amended by adding a chapter to read:
CHAPTER 33
WATER OBSTRUCTION
AND ENCROACHMENT PERMITS
Sec.
3301. Definitions.
3302. De minimis impact project permits.
§ 3301. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"De minimis impact project." The construction, maintenance,

testing, repair, rehabilitation or replacement of water
obstructions and encroachments that create a disturbance that
affects an area not larger than 1/20 of an acre located within a
floodway.
"Department." The Department of Environmental Protection of
the Commonwealth.
§ 3302. De minimis impact project permits.
The fee for a permit under 25 Pa. Code Ch. 105 (relating to
dam safety and waterway management) for a de minimis impact
project is $100.
Section 2. This act shall take effect in 60 days.
