AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
providing for the establishment of the Public Assistance
Monitoring Program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 414.1. Public Assistance Monitoring Program.--(a)
The department shall establish a program to be known as the
Public Assistance Monitoring Program.
(b) The purpose of the program is to deter fraud and abuse
of public assistance programs.
(c) The following shall participate in the program:
(1) A person who is a new resident applying for assistance.
(2) Any provider or payee required to provide care or
oversee the benefits received by the person receiving

assistance.
(d) The department shall monitor a provider or payee
quarterly for the first year a new resident is receiving
benefits in order to verify that the provider or payee is
providing adequate care or properly overseeing the benefits
received.
(e) It shall be a violation for a provider or payee not to
provide adequate care to or properly oversee the benefits
received by the person receiving assistance. The Attorney
General may, at the request of the department, investigate an
alleged violation of this subsection and institute and prosecute
legal proceedings against a provider or payee who may be liable
for a violation. The department may also, if appropriate, refer
the matter to any other Federal, State or local law enforcement
agency.
(f) The department shall conduct at least one site visit for
each new resident to verify compliance with program
requirements.
(g) The department shall promulgate rules to implement this
section.
(h) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection:
"New resident" means a person who has resided in this
Commonwealth for less than twelve months.
"Program" means the Public Assistance Monitoring Program.
Section 2. This act shall take effect in 90 days.
