AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in particular rights and
immunities, providing for civil immunity for humane society
police officers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 8332.9. Civil immunity for humane society police officers.
(a) General rule.--A humane society police officer acting
within the scope of the authority provided in 18 Pa.C.S. § 5511
(relating to cruelty to animals) shall not be liable for civil
damages as a result of any act or omission in the course of an
investigation or enforcement action.
(b) Nonapplicability.--Subsection (a) shall not apply to any
act or omission intentionally designed to harm, to any act or
omission that constitutes gross negligence or to any willful,
wanton or reckless conduct.

(c) Definition.--The term "humane society police officer"
shall have the same meaning given in 22 Pa.C.S. § 3702 (relating
to definitions).
Section 2. This act shall take effect in 60 days.
