AN ACT
Amending the act of December 22, 1983 (P.L.306, No.84), entitled
"An act providing for the State Board of Vehicle
Manufacturers, Dealers and Salespersons; and providing
penalties," further providing for definitions and for license
to engage in business.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2 of the act of December 22, 1983
(P.L.306, No.84), known as the Board of Vehicles Act, is amended
by adding a definition to read:
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Salvage vehicle." A salvaged vehicle as defined in 75
Pa.C.S. ยง 102 (relating to definitions).

Section 2. Section 5(f) and (g) of the act are amended by

adding paragraphs to read:
Section 5. License to engage in business.

(f) Wholesale vehicle auction activities.--
* * *
(6) A wholesale vehicle auction may conduct up to five
wholesale vehicle auction events per calendar year at sites
that are not the wholesale vehicle auction's established
place of business. A wholesale vehicle auction conducting an
auction event at a site that is not the wholesale vehicle
auction's established place of business may not include the
buying, selling or exchanging of a salvage vehicle.
(g) Public or retail vehicle auction activities.--

(3) A public or retail vehicle auction may conduct up to
five public or retail vehicle auction events per calendar
year at sites that are not the public or retail vehicle
auction's established place of business. A public or retail
vehicle auction conducting an auction event at a site that is
not the public or retail vehicle auction's established place
of business may not include the buying, selling or exchanging
of a salvage vehicle.

Section 3. This act shall take effect in 60 days.
