A CONCURRENT RESOLUTION
Urging the Congress of the United States to propose an amendment
entitled the "Regulation Freedom Amendment" to the
Constitution of the United States, which shall mandate
Congressional approval of any regulation opposed by at least
one quarter of the members of the House of Representatives of
the United States.
WHEREAS, The growth and abuse of Federal regulatory authority
threaten our Constitutional liberties, including those
guaranteed by the Bill of Rights in the First, Second, Fourth
and Fifth Amendments of our Constitution; and
WHEREAS, Federal regulators must be held accountable to the
elected representatives of the people; and
WHEREAS, The United States House of Representatives has
passed, with bipartisan support, the Regulations From the
Executive In Need of Scrutiny Act, or REIN Act, to require that
Congress approve any major new Federal regulation before the
regulation takes effect; and
WHEREAS, Even if enacted, however, a law such as the REIN
Act, may be repealed or waived by a future Congress and

President; and
WHEREAS, An amendment to the United States Constitution does
not require the President's approval and cannot be waived by a
future Congress and President; therefore be it
RESOLVED (the House of Representatives concurring), That the
General Assembly urge the Congress of the United States to
propose an amendment to the Constitution of the United States
that would require Congressional approval of any regulation
opposed by at least one quarter of the members of either Chamber
of the Congress of the United States, which shall take the
following form:
Whenever one quarter of the members of the United States
House of Representatives or the United States Senate
transmits to the President their written declaration of
opposition to a proposed Federal regulation, it shall require
a majority vote of the House of Representatives and the
Senate to adopt that regulation;
and be it further
RESOLVED, That a certified copy of this resolution be
transmitted by the Secretary of the Senate to the President of
the United States Senate, the Speaker of the United States House
of Representatives and each member of the Pennsylvania
delegation to Congress.
