AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in restructuring of electric utility
industry, further providing for additional alternative energy
sources.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2814 of Title 66 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 2814. Additional alternative energy sources.

(d) Landfill gas.--The term "customer generator" as defined
under section 2 of the Alternative Energy Portfolio Standards
Act shall also include municipally owned landfills that generate
electricity using landfill methane gas. The commission and
electric distribution companies may permit a municipally owned
landfill to utilize net metering regardless of the municipally
owned landfill's requirements for electricity.
Section 2. This act shall take effect in 60 days.
