AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in preliminary provisions, providing
for prohibition of the use of the Pennsylvania Prevailing
Wage Act.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 124. Prohibition of the Use of the Pennsylvania
Prevailing Wage Act.--(a) No contract entered into by a school
district, charter school, cyber charter school or institution of
higher education under this act for a public work, as defined in
section 2 of the act of August 15, 1961 (P.L.987, No.442), known
as the "Pennsylvania Prevailing Wage Act," shall be subject to
the Pennsylvania Prevailing Wage Act.
(b) As used in this section, the following words and phrases

shall have the meanings given to them in this subsection:
"Charter school." As defined in section 1703-A of this act.
"Cyber charter school." As defined in section 1703-A of this
act.
"Institution of higher education." As defined in section
1901-F of this act.
Section 2. The addition of section 124 of the act shall
apply to any contract entered into on or after the effective
date of this section.
Section 3. This act shall take effect in 60 days.
