AN ACT
Authorizing the release of Project 70 restrictions on certain
land owned by the Borough of Carlisle, Cumberland County, in
return for the development of park and open-space lands
within the Borough of Carlisle NORTH MIDDLETON TOWNSHIP,
Cumberland County.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Release of restrictions in the Borough of Carlisle
NORTH MIDDLETON TOWNSHIP, Cumberland County.
(a) Authorization.--Pursuant to the requirements of section
20(b) of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
known as the Project 70 Land Acquisition and Borrowing Act, the
General Assembly hereby approves the release of Project 70
restrictions from the land owned by the Borough of Carlisle,
Cumberland County, which is more particularly described in
subsection (c), in exchange for the development of park and open
space-lands described in subsection (d).
(b) Land to be released from Project 70 restrictions.--The
Borough of Carlisle intends to sell a portion of the land it

owns for highway right-of-way purposes and therefore wishes to
release the land described in subsection (c) from Project 70
restrictions.
(c) Description of premise to be conveyed.--The land
referred to in subsection (b) is ALL THAT CERTAIN tract of land
situate in the Borough of Carlisle NORTH MIDDLETON TOWNSHIP,
Cumberland County, Pennsylvania being shown as the Required
Right-of-Way Area on the plan entitled "Shaffer Park --
Acquisition of Right-of-Way Plan" dated November 7, 2014 and
prepared by Raudenbush Engineering, Inc., Pittsburgh, PA and
being more fully described as follows:
BEGINNING at a point of origin found at the westerly corner of
lands now or formerly of Carlisle Borough, Parcel No.29-18-1369-
037, per Plan Book 75 Page 75, said point being located along
the existing Legal Right-of-Way Line of the westbound lanes of
the Pennsylvania Turnpike;
Thence along the Property Line of Carlisle Borough, North
28°50'41" West, a distance of 20.31 feet to a point in said
Property Line;
Thence North 71°14'10" East, a distance of 58.76 feet to a
point;
Thence North 18°45'50" West, a distance of 20.00 feet to a
point;
Thence North 71°14'10" East, a distance of 350.00 feet to a
point;
Thence South 18°45'50" East, a distance of 20.00 feet to a
point;
Thence North 71°14'10" East, a distance of 100.00 feet to a
point;
Thence South 18°45'50" East, a distance of 19.99 feet to a

point, said point being co-located along the Property Line of
CarlisleBorough CARLISLE BOROUGH and the existing Legal Right-
of-way Line of the westbound lanes of the Pennsylvania Turnpike;
Thence along said Property Line of CarlisleBorough CARLISLE
BOROUGH and the existing Legal Right-of-way Line of the
westbound lanes of the Pennsylvania Turnpike, South 71°14'10"
West, a distance of 505.21 feet along the Property Line of
Carlisle Borough and the existing Legal Right-of-way Line of the
westbound lanes of the Pennsylvania Turnpike to the Point of
BEGINNING.
Containing 0.393 acres, more or less.
(d) Use of sale proceeds and interest.--An amount equal to
or greater than the right-of-way acquisition payment made to the
Borough of Carlisle for the land described in subsection (c)
shall be deposited into a special interest-bearing account
established by the Borough of Carlisle for development of park
and open-space lands in OWNED BY the Borough of Carlisle. None
of the funds shall be disbursed from this special account until
a plan is developed by the Borough of Carlisle for use of the
funds by the borough and the plan has been approved by the
Department of Conservation and Natural Resources. Any funds
remaining in the special account five years after the date of
deposit by the Borough of Carlisle shall immediately be paid to
the Commonwealth for deposit into the Project 70 Land
Acquisition Sinking Fund or current equivalent.
Section 2. Effective date.
This act shall take effect immediately.
