AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, in municipal authorities, further
providing for purposes and powers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5607(d) of Title 53 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 5607. Purposes and powers.

(d) Powers.--Every authority may exercise all powers
necessary or convenient for the carrying out of the purposes set
forth in this section, including, but without limiting the
generality of the foregoing, the following rights and powers:

(35) To operate as an aggregator or market aggregator,
as those terms are defined in 66 Pa.C.S. § 2803 (relating to
definitions), and to solicit bids from electricity suppliers
for the sole purpose of selling electricity to residents of

the municipality or municipalities that organized the
authority or to any municipality or school district located
wholly or partially within the boundaries of the municipality
or municipalities that organized the authority, provided that
the authority may not require residents to purchase
electricity from the authority.

Section 2. This act shall take effect in 60 days.
