AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
further providing for persons eligible for medical
assistance.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 441.1 of the act of June 13, 1967
(P.L.31, No.21), known as the Public Welfare Code, is amended by
adding a subsection to read:
Section 441.1. Persons Eligible for Medical Assistance.--* *

(c) The Commonwealth shall enter into an agreement with the
Secretary of the United States Department of Health and Human
Services to expand eligibility to persons described under
section 1902(a)(10)(A)(i)(VIII) of the Social Security Act (49
Stat. 620, 42 U.S.C. § 1396a(a) (10)(A)(i)(VIII)). The department
shall submit a revised State plan if required to implement the

expansion of eligibility under this subsection. This subsection
shall not apply if the Federal medical assistance percentage
under section 1905(y) of the Social Security Act (49 Stat. 620,
42 U.S.C. § 1396d(y)) is less than the following:
(1) One hundred percent for calendar quarters in 2014, 2015
and 2016.
(2) Ninety-five percent for calendar quarters in 2017.
(3) Ninety-four percent for calendar quarters in 2018.
(4) Ninety-three percent for calendar quarters in 2019.
(5) Ninety percent for calendar quarters in 2020 and each
year thereafter.
Section 2. This act shall take effect immediately.
