AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in inchoate crimes, further providing
for possession of weapon on school property.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 912(c) of Title 18 of the Pennsylvania
Consolidated Statutes is amended to read:
§ 912. Possession of weapon on school property.

(c) Defense.--It shall be a defense that the weapon:
(1) is possessed and used in conjunction with a lawful
supervised school activity or course [or];
(2) is possessed by either a qualified law enforcement
officer as defined in 18 U.S.C. § 926B(c) (relating to
carrying of concealed firearms by qualified law enforcement
officers) or a qualified retired law enforcement officer as
defined in 18 U.S.C. § 926C(c) (relating to carrying of
concealed firearms by qualified retired law enforcement

officers); or
(3) is possessed for other lawful purpose.
Section 2. This act shall take effect in 60 days.
