AN ACT
Amending the act of April 23, 1956 (1955 P.L.1510, No.500),
entitled, as amended, "An act providing for the prevention
and control of communicable and non-communicable diseases
including venereal diseases, fixing responsibility for
disease prevention and control, requiring reports of
diseases, and authorizing treatment of venereal diseases, and
providing for premarital and prenatal blood tests; amending,
revising and consolidating the laws relating thereto; and
repealing certain acts," further providing for the title of
the act, for definitions and for reports; providing for
reports of data; and further providing for rules and
regulations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The title of the act of April 23, 1956 (1955
P.L.1510, No.500), known as the Disease Prevention and Control
Law of 1955, amended July 5, 1957 (P.L.495, No.279), is amended
to read:

responsibility for disease prevention and control, requiring
reports of diseases, drug overdoses and overdose reversals,
and authorizing treatment of venereal diseases, and providing
for premarital and prenatal blood tests; amending, revising
and consolidating the laws relating thereto; and repealing
certain acts.
Section 2. Section 2 of the act is amended by adding
subsections to read:
Section 2. Definitions.--

(d.2) Drug overdose. An acute medical condition, including,
but not limited to, severe physical illness, coma, mania,
hysteria or death, which is the result of consumption or use of
one or more controlled substances causing an adverse reaction. A
patient's condition shall be deemed to be a drug overdose if a
prudent layperson, possessing an average knowledge of medicine
and health, would reasonably believe that the condition is in
fact a drug overdose and requires immediate medical attention.

(h.1) Overdose reversal. The life-saving act of
administering naloxone to a person experiencing a drug overdose.

Section 3. Section 4(a) of the act is amended to read:
Section 4. Reports.--
(a) Every physician who treats or examines any person who is
suffering from or who is suspected of having a communicable
disease or drug overdose, or any person who is or who is
suspected of being a carrier, shall make a prompt report of the
disease, overdose or overdose reversal in the manner prescribed
by regulation to the local board or department of health which

serves the municipality where the disease occurs or where the
carrier resides or to the department if so provided by
regulation.

Section 4. The act is amended by adding a section to read:
Section 14.2. Reports of Data.--The department shall report
county-level data on drug overdose and overdose reversals on a
quarterly basis. The reports shall be submitted to the Committee
on Public Health and Welfare of the Senate and the Committee on
Health and Human Services of the House of Representatives and
shall be posted on the department's publicly accessible Internet
website each quarter year.
Section 5. Section 16(a)(1), (2) and (12) of the act are
amended to read:
Section 16. Rules and Regulations.--
(a) The Board may issue rules and regulations with regard to
the following:
(1) the communicable and non-communicable diseases, drug
overdoses and overdose reversals which are to be reportable;
(2) the methods of reporting of diseases, drug overdoses and
overdose reversals the contents of reports and the health
authorities to whom diseases are to be reported;

(12) any other matters it may deem advisable for the
prevention and control of disease or drug overdose and for
carrying out the provisions and purposes of this act.

Section 6. This act shall take effect in 60 days.
