AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, providing for inmate solicitations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 61 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 5902.1. Inmate solicitations.
(a) Prohibition.--An inmate may not do any of the following:
(1) Use correspondence privileges to solicit or
advertise for any of the following:
(i) Money.
(ii) Property other than money.
(iii) Services.
(iv) The establishment of a correspondence
relationship with another person.

(2) Act with or through another person to violate
paragraph (1).
(b) Penalty.--For a violation of subsection (a), the
following apply:
(1) An inmate in a State correctional institution is
subject to discipline under 37 Pa. Code § 93.10 (relating to
inmate discipline).
(2) An inmate in a county correctional institution is
subject to discipline under:
(i) section 1756 (relating to loss of privileges);
or
(ii) 37 Pa. Code § 95.240 (relating to inmate
disciplinary procedures).
Section 2. The addition of 61 Pa.C.S. § 5902.1(b) shall
apply to violations which occur on or after the effective date
of this section.
Section 3. This act shall take effect in 60 days.
