AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in pupils and attendance, prohibiting
smoking at bus stops.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1368. Smoking Prohibited.-- (a) A student of a
public school, private school or charter school may not smoke
within twenty-five (25) feet of a school bus stop.
(b) The prohibition under subsection (a) shall be enforced
as follows:
(1) The prohibition shall include only the outdoor area
within twenty-five (25) feet of the bus stop.
(2) If the bus stop is a public stop also used by public

transportation, the prohibition shall apply only to the
students.
(3) If the bus stop is on a corner, the twenty-five (25)
foot radius shall be calculated from the side of the corner
where the students congregate to wait for the bus.
(4) If the bus stop is at a residence, the twenty-five (25)
foot radius shall be calculated from one of the following:
(i) The center point of the driveway where the driveway
meets the road.
(ii) If there is no driveway, the point at the street
directly in front of the front door of the residence or
business.
(c) A school may enforce this section through appropriate
disciplinary action and an appropriate fine after an
investigation that may include a statement from a school bus
driver, a student's parent or another student. The statement can
be made either in writing or verbally to the appropriate school
official in charge of administering this section, however, the
report must always include the name of the person making the
report, the location of the alleged offense, the name or
physical description, or both, of the alleged offender and the
time of day that the offense allegedly occurred.
Section 2. This act shall take effect in 60 days.
