AN ACT
Providing for additional points on civil service examinations
for individuals with a disability.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Civil Service
Employment for Individuals with Disabilities Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Individual with a disability." An individual who has a
disability as defined in section 3 of the Americans with
Disabilities Act (Public Law 101-336, 42 U.S.C. ยง 12102) and who
provides sufficient documentation of the disability to the
person administering a civil service examination.
Section 3. Civil service examinations.

(a) Commonwealth examinations.--The following shall apply
for an individual with a disability who successfully passes a
civil service appointment or promotional examination for a
public position with the Commonwealth:
(1) The individual's examination shall be graded an
additional five points above the grade credited for the
examination, which shall represent the individual's final
grade.
(2) The total grade obtained under paragraph (1) shall
represent the final grade of the individual and shall
determine the individual's standing on any appointment or
promotional list certified or furnished to the appointing or
promoting power.
(b) Municipality examinations.--An examination for
appointment or promotion in the civil service of a municipality
taken by an individual with a disability shall be graded or
marked 5% perfect before the contents or quality of the
examination is considered.
Section 4. Effective date.
This act shall take effect in 60 days.
