AN ACT
Amending Title 23 (Domestic Relations) of the Pennsylvania
Consolidated Statutes, in support matters generally, further
providing for general administration of support matters.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 4305(b)(10) of Title 23 of the
Pennsylvania Consolidated Statutes is amended by adding a
subparagraph to read:
§ 4305. General administration of support matters.

(b) Additional powers.--Subject to the supervision and
direction of the court but without the need for prior judicial
order, the domestic relations section shall have the power to
expedite the establishment and enforcement of support to:

(10) Issue orders in cases where there is a support
arrearage to secure assets to satisfy current support

obligation and the arrearage by:

(vii) Charging interest on the amount of overdue
support. Interest shall be calculated at the rate equal
to the prime rate as listed in the first edition of the
Wall Street Journal published for each calendar year for
which interest is charged, plus 1% not compounded, or 6%
annually, whichever is greater. The interest shall be
paid to the obligee. As used in this subparagraph, the
term "overdue support" shall mean the amount of
delinquent support equal to or greater than one month's
support obligation which accrues after entry or
modification of a support order as a result of the
obligor's nonpayment of that order.

Section 2. The addition of 23 Pa.C.S. § 4305(b)(10)(vii)
shall apply to child support orders entered on or after the
effective date of this section.
Section 3. This act shall take effect in 60 days.
