AN ACT
Requiring self-service gasoline stations to provide refueling
assistance for individuals with disabilities.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Refueling
Assistance for Individuals with Disabilities Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Individual with disabilities." An individual who:
(1) has a physical or mental impairment that
substantially limits one or more of the major life activities
of the individual;
(2) has a record of a physical or mental impairment that
substantially limits one or more of the major life activities

of the individual; or
(3) is regarded as having a physical or mental
impairment that substantially limits one or more of the major
life activities of the individual.
"Self-service gasoline station." A place of business
engaging in the sale at retail in this Commonwealth of gasoline,
diesel fuel or kerosene that permits customers to refuel their
vehicles by themselves without assistance from an employee.
Section 3. Refueling assistance for individuals with
disabilities.
(a) Duties.--Except as provided under subsection (b), in
accordance with the Americans with Disabilities Act of 1990
(Public Law 101-336, 104 Stat. 327), a self-service gasoline
station shall have the following duties:
(1) Providing assistance to an individual with
disabilities who requests assistance in refueling his or her
vehicle at no additional charge.
(2) Providing notice of the assistance available under
paragraph (1) in an area clearly visible to customers of the
self-service gasoline station.
(b) Exception.--Subsection (a) shall not apply to a self-
service gasoline station that is operated by no more than one
employee.
Section 4. Effective date.
This act shall take effect in 60 days.
