AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in intermediate units, further
providing for loan of textbooks, instructional materials and
instructional equipment, nonpublic school children.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 923-A of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended by adding a subsection to read:
Section 923-A. Loan of Textbooks, Instructional Materials
and Instructional Equipment, Nonpublic School Children.--* * *
(f) State budget impasse. The following apply:
(1) If a State budget has not been enacted as of July 15
of any calendar year, the department shall utilize
undistributed funds not expended, encumbered or committed on
account of textbooks, materials and equipment for nonpublic

schools in order to provide for the purchase of non-reusable
workbooks.
(2) If the amount available under paragraph (1) is less
than two million dollars ($2,000,000), the department shall
utilize any undistributed funds not expended, encumbered or
committed on account of general government operations in
order to allocate not less than two million dollars
($2,000,000) for the purposes described under paragraph (1).
(3) Subsequent to the enactment of a general
appropriations act, the amount allocated pursuant to this
subsection shall be deducted from the total allocation made
on behalf of the children enrolled in each nonpublic school.
Section 2. This act shall take effect in 60 days.
