AN ACT
Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
Statutes, in development, further providing for well
reporting requirements.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3222(a) of Title 58 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding a subsection to read:
ยง 3222. Well reporting requirements.
(a) [General rule] Annual reports.--[Except as provided in
subsection (a.1), each]
(1) Each well operator shall file with the department,
on a form provided by the department, an annual report
specifying the amount of production, on the most well-
specific basis available, along with the status of each well,
except that in subsequent years only changes in status must
be reported. The report may be submitted electronically or by
United States mail at the discretion of the well owner.

(2) The Commonwealth may utilize reported information in
enforcement proceedings, in making designations or
determinations under section 1927-A of the act of April 9,
1929 (P.L.177, No.175), known as The Administrative Code of
1929, or in aggregate form for statistical purposes.

(e) Applicability.--
(1) No report shall be required of an owner or operator
of an operating well that was drilled prior to the effective
date of this section for the purpose of supplying fuel to a
residential property, including a residential dwelling or any
structure auxiliary to a residential dwelling, on which the
operating well is situated.
(2) A report required for a well drilled after the
effective date of this subsection may be submitted
electronically or by United States mail at the discretion of
the well owner.
(3) This subsection does not apply to the reporting
requirements under section 3220 (relating to plugging
requirements).
Section 2. This act shall take effect in 60 days.
