AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in forfeitures, providing
for Pennsylvania Game Commission forfeitures.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6803. Pennsylvania Game Commission forfeitures.
If the Pennsylvania Game Commission seized the property of an
individual who is suspected of violating a provision of 34
Pa.C.S. (relating to game) and the individual is found not
guilty of the violation, the individual may file a motion for
return of property under Rule 588 of the Pennsylvania Rules of
Criminal Procedure before the court of common pleas. If the
Pennsylvania Game Commission challenges the motion and loses the
challenge, the Pennsylvania Game Commission shall pay the
individual's court costs directly related to the motion for the
return of the seized property.

Section 2. This act shall take effect in 60 days.
