AN ACT
Amending the act of December 19, 1988 (P.L.1262, No.156),
entitled, as amended, "An act providing for the licensing of
eligible organizations to conduct games of chance, for the
licensing of persons to distribute games of chance, for the
registration of manufacturers of games of chance, and for
suspensions and revocations of licenses and permits;
requiring records; providing for local referendum by
electorate; and prescribing penalties," further providing for
definitions; and providing for electronic pull-tabs,
electronic pull-tab devices and electronic pull-tab systems.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The definitions of "games of chance" and "tavern
games" in section 103 of the act of December 19, 1988 (P.L.1262,
No.156), known as the Local Option Small Games of Chance Act,
amended or added November 27, 2013 (P.L.1045, No.90) and
November 27, 2013 (P.L.1062, No.92), are amended and the section
is amended by adding definitions to read:
Section 103. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Electronic pull-tab." A version of a pull-tab authorized
under this act that is a predetermined game outcome in
electronic form, distributed on-demand from a finite number of
game outcomes by an electronic pull-tab game system.
"Electronic pull-tab device." An electronic device used to
facilitate the play of an electronic pull-tab that may take the
form of an upright cabinet, a handheld device or any other
composition as approved by the department.
"Electronic pull-tab system." Equipment leased from a
licensed distributor and used by a licensed eligible
organization, or a licensee under Chapter 9, to conduct, manage
and record electronic pull-tab games and to report and transmit
the game results as prescribed by the department.

"Games of chance." Punchboards, daily drawings, weekly
drawings, 50/50 drawings, raffles, [tavern games, pools, race
night games] electronic pull-tabs, and pull-tabs, as defined in
this act, provided that no such game shall be played by or with
the assistance of any mechanical or electrical devices or media
other than a dispensing machine, an electronic pull-tab device
or passive selection device and further provided that the
particular chance taken by any person in any such game shall not
be made contingent upon any other occurrence or the winning of
any other contest, but shall be determined solely at the
discretion of the purchaser. This definition shall not be
construed to authorize any other form of gambling currently
prohibited under any provision of 18 Pa.C.S. (relating to crimes
and offenses) or authorized under 4 Pa.C.S. (relating to
amusements). Nothing in this act shall be construed to authorize

games commonly known as "slot machines" or "video [poker" or
other games regulated by the Pennsylvania Gaming Control Board.]
poker."

"Tavern games." Pull-tabs, electronic pull-tabs, tavern
daily drawings and tavern raffles.

Section 2. The act is amended by adding sections to read:
Section 309. Electronic pull-tabs.
(a) Authorization.--Notwithstanding any other provision of
law, a licensed eligible organization or a licensee under
Chapter 9 may conduct electronic pull-tabs, so long as the
electronic pull-tabs are:
(1) A predetermined, finite number of winning and losing
tickets, not to exceed 7,500 tickets.
(2) The same price for each ticket in the game.
(3) In conformance with applicable department
regulations for pull-tabs.
(4) In compliance with prize limits under this act.
(5) Provided a unique serial number that may not be
regenerated.
(6) Provided a display that shows the game name, form
number, predetermined and finite number of tickets in the
game and prize tier.
(7) Not revealed through spinning reels.
Section 310. Electronic pull-tab devices.
(a) General rule.--Electronic pull tab devices shall
maintain a printable, permanent record of all transactions
involving each device and electronic pull-tab games played on
the device.

(b) Number of devices.--
(1) The number of electronic pull-tab devices that are
part of an upright cabinet structure shall be limited to 10
devices per licensed premises.
(2) The number of handheld electronic pull-tab devices
present at any licensed premises shall be limited to 25.
(3) The department shall determine whether an electronic
pull-tab device is part of an upright cabinet structure or a
handheld device.
(c) Device attributes.--In addition to a video monitor or
touch screen, an electronic pull-tab device may have one or more
of the following:
(1) bill acceptor;
(2) printer;
(3) electromechanical buttons for activating the game
and providing player input, including a means for the player
to make selections and choices in games; and
(4) any other attribute authorized by the department.
(d) Restrictions.--
(1) An electronic pull-tab device shall not have any of
the following:
(i) spinning or mechanical reels;
(ii) pull handle;
(iii) sounds or music solely intended to entice a
player to play;
(iv) if the device is part of an upright cabinet
structure, flashing lights that are fixed to the upright
cabinet structure;
(v) means of manipulation that could affect the
operation or outcome of a game; or

(vi) any other restriction identified by the
department.
(2) No electronic pull-tab device may be used for the
purpose of engaging in any game prohibited by the department.
(e) Regulatory authority.—The department shall promulgate
regulations establishing standards, requirements and procedures
for electronic pull-tabs, electronic pull-tab devices and
electronic pull-tab game systems, including regulations relating
to manufacturers and distributors of electronic pull-tab devices
and electronic pull-tab game systems.
Section 311. Electronic pull-tab game system.
(a) Operation.--A licensed eligible organization or a
licensee under Chapter 9 that operates electronic pull-tabs
shall maintain an electronic pull-tab system at its licensed
premises to conduct, manage and record information relating to
electronic pull-tab games.
(b) Critical data retention.--An electronic pull-tab device
shall be linked to an electronic pull-tab system that stores and
preserves critical data in accordance with requirements
established by the department. The electronic pull-tab system
shall provide security and access levels sufficient so that
internal control objectives and the reporting and transmission
of information are satisfied as prescribed by the department.
Section 3. This act shall take effect in 60 days.
