AN ACT
Providing for temporary emergency budget funds.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Temporary
Emergency Budget Fund Act.
Section 2. Temporary Emergency Budget Fund.
(a) Establishment.--The Temporary Emergency Budget Fund is
established as a separate fund in the State Treasury. The money
in the fund is appropriated on a continuing basis to carry out
the provisions of this section.
(b) Transfers.--If legislation providing for appropriations
from the General Fund for the ordinary programs of the
Commonwealth is not enacted by July 1, 2015, the State Treasurer
shall periodically transfer unappropriated, unrestricted General
Fund money, to the extent that the funds are available, to the
Temporary Emergency Budget Fund. The transfers shall be at the

times as necessary to meet the required payments of the
Commonwealth, but shall not exceed the total amount appropriated
under the General Appropriations Act of the previous fiscal
year.
(c) Certification of transfers.--If the Governor fails to
certify revenue estimates under section 618 of the act of April
9, 1929 (P.L.177, No.175), known as The Administrative Code of
1929, for the current fiscal year the Secretary of Revenue shall
certify to the State Treasurer each time a transfer is needed
under subsection (a) that there is adequate unappropriated,
unrestricted General Fund money to make the transfer.
Section 3. Payments from the fund.
The Secretary of the Budget shall draw a warrant on the State
Treasurer for amounts to be paid from the fund, which shall not
exceed the total amount as provided in the General
Appropriations Act of the previous fiscal year.
Section 4. Limitation.
Transfers and payments under this act shall only be in effect
during the time in which no General Appropriations Act has been
enacted.
Section 5. Applicability.
This act shall apply to fiscal years beginning after June 30,
2015.
Section 6. Effective date.
This act shall take effect immediately.
