AN ACT
Amending the act of December 2, 1968 (P.L.1144, No.358),
entitled "An act to provide for the office of public
defender, authorizing assistants and other personnel, and to
provide adequate representation for persons who have been
charged with an indictable offense or with being a juvenile
delinquent, who for lack of sufficient funds are unable to
obtain legal counsel," further providing for expenses for
parole proceedings.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 10.1 of the act of December 2, 1968
(P.L.1144, No.358), known as the Public Defender Act, added
December 23, 1981 (P.L.590, No.172), is amended to read:
Section 10.1. Expenses for Parole and Mental Health
Proceedings.--(a) The county which imposed the sentence from
which the defendant was paroled shall be responsible for
reimbursing the public defender's office of any other county for
reasonable expenses incurred for representing that defendant in
a parole revocation proceeding and appeals therefrom.
(b) The county which imposed the sentence to a State or
county correctional institution shall be responsible for

reimbursing the public defender's office of any other county for
reasonable expenses incurred for representing an inmate in
proceedings under the act of July 9, 1976 (P.L.817, No.143),
known as the "Mental Health Procedures Act," and appeals
therefrom.
Section 2. This act shall take effect in 60 days.
