AN ACT
Amending Titles 4 (Amusements) and 18 (Crimes and Offenses) of
the Pennsylvania Consolidated Statutes, in Pennsylvania
Gaming Control Board, further providing for general and
specific powers and, in riot, disorderly conduct and related
offenses, further providing for gambling devices, gambling,
etc.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1202(a) of Title 4 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 1202. General and specific powers.
(a) General powers.--

(7) The board shall not promulgate rules and regulations
allowing any form of Internet gambling.

Section 2. Section 5513(e) of Title 18 is amended and the
section is amended by adding a subsection to read:
§ 5513. Gambling devices, gambling, etc.

(d.1) Internet gambling.--No individual or entity shall
solicit, invite, collect or accept cash or any other form of
currency through the Internet for the purposes of wagering or
betting. No individual or entity shall organize, or cause to be
organized, any type of gambling event that is held over the
Internet.
(e) Penalty.--
(1) Any person who fails to provide records as provided
in subsection (d) commits a summary offense.
(2) A first offense under subsection (d.1) shall be
considered a first offense punishable by a fine of not more
than $300.
(3) A second offense under subsection (d.1) shall be
considered a summary offense punishable by a fine of not more
than $600 and a term of imprisonment not to exceed three
days.
(4) A third or subsequent offense under subsection (d.1)
shall be considered a third degree misdemeanor.

Section 3. The following provisions shall apply to bets and
wagers placed on or after the effective date of this section:
(1) The addition of 4 Pa.C.S. § 1202(a)(7).
(2) The amendment or addition of 18 Pa.C.S. § 5513(d.1)
and (e).
Section 4. This act shall take effect in 60 days.
