AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in sentencing authority,
providing for global positioning system device to be worn by
certain offenders.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 9720.7. Global positioning system device to be worn by
certain offenders.
(a) Condition of probation or parole.--
(1) A person who is placed on probation or released on
parole after a conviction for stalking as defined in 18
Pa.C.S. § 2709.1 (relating to stalking) may be required as a
condition of probation or parole to wear a global positioning
system device or comparable device.
(2) The order for probation or parole shall establish
defined geographic exclusion zones in order to minimize the
offender's contact with the victim and other potential

victims.
(3) If the offender enters an excluded zone, the
offender's location data shall be immediately transmitted by
the device to the police department in the municipality where
the violation occurred and to the probation or parole
officer, by telephone, electronic beeper, paging device or
other appropriate means.
(b) Fees.--The fees incurred for the installation,
maintenance and operation of the global positioning system
device or comparable device shall be paid by the offender.
Section 2. This act shall take effect in 60 days.
