AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in particular rights and
immunities, further providing for criminal victim aid good
Samaritan civil immunity.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 8331.3 of Title 42 of the Pennsylvania
Consolidated Statutes is amended to read:
ยง 8331.3. Criminal victim aid good Samaritan civil immunity.
(a) General rule.--Any person who provides or obtains or
attempts to provide or obtain reasonable assistance for a victim
of a personal injury crime at the scene of the personal injury
crime or attempted personal injury crime shall not be liable for
any civil damages as a result of any acts or omissions in
providing or obtaining or attempting to provide or obtain
reasonable assistance, except any acts or omissions
intentionally designed to harm or any acts or omissions that
constitute gross negligence or willful, wanton or reckless
conduct.

(a.1) Duty to assist.--The following shall apply:
(1) A person at the scene of a personal injury crime or
attempted personal injury crime who knows that another person
is exposed to or has suffered grave physical harm shall, to
the extent that the person can do so without danger or peril
to self or others, give reasonable assistance to the victim.
Reasonable assistance includes, but is not limited to,
obtaining or attempting to obtain aid from law enforcement or
medical personnel.
(2) A person who violates this subsection commits a
summary offense.
(b) Definitions.--The terms "personal injury crime" and
"victim" shall have the same meanings given to them in section
103 of the act of November 24, 1998 (P.L.882, No.111), known as
the Crime Victims Act.
Section 2. This act shall take effect in 60 days.
