AN ACT
Amending Titles 34 (Game) and 75 (Vehicles) of the Pennsylvania
Consolidated Statutes, providing for the removal of deer
carcasses.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 322(c) of Title 34 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 322. Powers and duties of commission.

(c) Specific powers and duties.--In order to administrate
and enforce this title, the commission through proper action
shall:

(14) Within 48 hours of notification of the location of
a deer carcass on a roadway, remove the carcass from the
roadway. For the purposes of this paragraph, a roadway shall
mean a roadway as defined in 75 Pa.C.S. § 102 (relating to
definitions), except that the term shall not include a

roadway under the jurisdiction of the Department of
Transportation.
Section 2. Title 75 is amended by adding a section to read:
§ 6109.1. Specific duties of department.
The department shall have the following duties:
(1) To, within 48 hours of notification of the location
of a deer carcass on a roadway, remove the carcass from the
roadway and properly dispose of the carcass under the
guidance of the Pennsylvania Game Commission. For the
purposes of this paragraph, a roadway shall not include a
roadway under the jurisdiction of a local authority.
(2) (Reserved).
Section 3. This act shall take effect in 60 days.
