AN ACT
1Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2Statutes, in general provisions, further providing for
3reciprocal limitations.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Section 107(d) of Title 62 of the Pennsylvania
7Consolidated Statutes is amended to read:
8§ 107. Reciprocal limitations.

10(d) Preference for resident bidders or offerors.--
11(1) When a contract for construction or supplies
12[exceeding the amount established by the department for small
13procurements under section 514] is to be awarded, a resident
14bidder or offeror shall be granted a preference as against a
15nonresident bidder or offeror [from any state that]
16regardless of whether or not the state in which the
17nonresident bidder or offeror resides gives or requires a
18preference to bidders or offerors from that state.
1(2) The amount of the preference shall be equal to [the
2amount of the preference applied by the state of the
3nonresident bidder or offeror] 10%.
