AN ACT

 

1Amending Title 53 (Municipalities Generally) of the Pennsylvania
2Consolidated Statutes, in neighborhood blight remediation and
3revitalization, providing for notice to Department of
4Transportation.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Title 53 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 6115. Notice to Department of Transportation.

10(a) Duty to report serious violation.--When there is a
11serious violation on a property in a municipality, the governing
12body of the municipality shall submit a report thereof to the
13Department of Transportation if all of the following conditions
14are satisfied:

15(1) The person who owns the property has been convicted
16of the serious violation.

17(2) All appeals on the conviction have been exhausted.

18(3) The person has taken no substantial corrective
19action to remediate the serious violation.

1(4) The conviction is the third such conviction for the
2person on the property.

3(b) Contents of report.--The report required under
4subsection (a) shall include the full name and address of the
5person who owns the property, a statement as to any prior
6serious violations on the property and any other information
7deemed necessary by the Department of Transportation.

8(c) Departmental review.--

9(1) After receipt of a report under subsection (a), the
10Department of Transportation shall determine if the
11conditions specified in subsection (a) are satisfied. In
12making its determination, the department may consult with the
13municipality's code enforcement officer or equivalent
14official.

15(2) If the department is satisfied that the conditions
16are satisfied, the department shall suspend the operating
17privileges of the person in accordance with subsection (d)
18and provide notice of the suspension to the person as
19provided by law.

20(d) Period of license suspension.--The period of suspension
21for a person who is subject to suspension of operating
22privileges under subsection (c) shall be as follows:

23(1) For a third serious violation, a 90-day period of
24suspension.

25(2) For a fourth or subsequent serious violation, an
26additional 30-day period of suspension for each such serious
27violation in excess of three.

28(3) For a conviction under 18 Pa.C.S. § 6504 (relating
29to public nuisances), a 90-day period of suspension.

30(4) For a conviction under 18 Pa.C.S. § 7510 (relating

1to municipal housing code avoidance), a 90-day period of
2suspension.

3Section 2. This act shall take effect in 60 days.
