AN ACT

 

1Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
2as amended, "An act relating to counties of the second class
3and second class A; amending, revising, consolidating and
4changing the laws relating thereto," in employees' retirement
5system, further providing for exceptions in favor of
6employees totally and permanently disabled.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1711 of the act of July 28, 1953
10(P.L.723, No.230), known as the Second Class County Code, is
11amended by adding a subsection to read:

12Section 1711. Exceptions in Favor of Employes Totally and
13Permanently Disabled.--* * *

14(d) Notwithstanding any provision of this act, any member of
15the police force or the fire department, and any county
16detective, sheriff or deputy sheriff may receive a retirement
17allowance plus a service increment, if any, in accordance with
18the provisions of section 1712, if he or she incurs a permanent
19mental or physical impairment in the line of duty that renders
20him or her unable to perform his or her duties, regardless of

1his or her age or service years.

2Section 2. This act shall take effect immediately.
