AN ACT

 

1Amending the act of August 26, 1971 (P.L.351, No.91), entitled 
2"An act providing for a State Lottery and administration
3thereof; authorizing the creation of a State Lottery
4Commission; prescribing its powers and duties; disposition of
5funds; violations and penalties therefor; exemption of prizes
6from State and local taxation and making an appropriation,"
7in State Lottery, further providing for powers and duties of
8secretary.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. Section 303(a)(11)(iv) of the act of August 26, 
121971 (P.L.351, No.91), known as the State Lottery Law, amended 
13June 30, 2011 (P.L.110, No.23), is amended to read:

14Section 303. Powers and duties of secretary.

15(a) Powers and duties enumerated.--In addition to the powers
16and duties provided by law and the act of April 9, 1929 
17(P.L.177, No.175), known as The Administrative Code of 1929, the
18secretary shall have the power and it shall be his duty to
19operate and administer the lottery, and to promulgate rules and
20regulations governing the establishment and operation thereof,

1including, but not limited to:

3(11) The apportionment of the total revenues accruing
4from the sale of lottery tickets or shares and from all other
5sources among:

7(iv) for property tax relief and free or reduced
8fare transit service for the elderly as provided in
9section 311. For fiscal years beginning [before July 1, 
102015] after June 30, 2014, no less than [27%] 25% of the 
11total revenues accruing from the sale of lottery tickets 
12or shares shall be dedicated to this subparagraph. [For 
13fiscal years beginning after June 30, 2015, no less than
1430% of the total revenues accruing from the sale of
15lottery tickets or shares shall be dedicated to this
16subparagraph.]

18Section 2. The regulation of the Department of Revenue at 61
19Pa. Code § 803.11(11)(iv) is abrogated to the extent that the
20regulation is inconsistent with this act.

21Section 3. This act shall take effect in 60 days.
