AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for use of miscellaneous motor
3vehicle business registration plates.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1337 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1337. Use of "Miscellaneous Motor Vehicle Business"
9registration plates.

10(a) General rule.--The department shall issue to owners of
11miscellaneous motor vehicle businesses with established places
12of business special registration plates which may be displayed
13on vehicles operated on highways in lieu of registering each
14vehicle individually. Registration plates issued under this
15section may be displayed upon vehicles only as provided for each
16of the following classes of miscellaneous motor vehicle
17business:

18(1) For a repair, detailing or towing business:

19(i) upon vehicles being used in the conduct of the

1repair or detailing business to retrieve, tow or deliver
2other vehicles or parts; and

3(ii) upon vehicles being repaired or detailed.

4(2) For a vehicle salvage dealer business:

5(i) upon vehicles being used in the conduct of the
6vehicle salvage dealer's business to retrieve or deliver
7vehicles, vehicle hulks, parts or materials; and

8(ii) upon vehicles being transported on their own
9wheels for the purpose of being dismantled or recycled.

10(3) For a transporter business upon vehicles being
11transported on their own wheels in the conduct of the
12transporter business.

13(4) For a financier or collector-repossessor business:

14(i) upon vehicles being used to pick up vehicles
15that are being repossessed; and

16(ii) upon vehicles being repossessed.

17(5) For a watercraft trailer business:

18(i) upon trailers used for the delivery of a new
19boat to its purchaser;

20(ii) upon trailers used for the transport of a used
21boat which is to be resold by the dealer; and

22(iii) upon trailers used for the transport of boats
23by a dealer to or from another boat dealer, warehouse,
24storage facility, boat show or repair facility or to and
25from a location where a boat is to be demonstrated,
26tested or inspected.

27(6) For all classes of miscellaneous motor vehicle
28businesses upon vehicles used for the personal pleasure or
29use of the owner of the miscellaneous motor vehicle business
30or members of the owner's immediate family, or when the

1business is a corporation, upon vehicles used for the
2pleasure or use of not more than three officers or members of
3the officer's immediate family or for the personal use of the
4regular employees of the business when operated by the
5employee.

6All vehicles specified in paragraphs (1)(i), (2)(i), (4)(i) and
7(6) must be titled in the name of the business or family member
8and sales tax must be paid.

9(b) Application for registration.--Application for
10registration in any of the "Miscellaneous Motor Vehicle
11Business" classes shall be made upon a form provided by the
12department and shall set forth the full name and business
13address of the applicant and such other information as the
14department shall require. The application shall be verified by
15the oath or affirmation of the applicant or, if the applicant is
16a partnership or a corporation, by a partner or officer.

17(c) Classes of "Miscellaneous Motor Vehicle Business".--

18(1) Repair or towing.--Any person regularly engaged in
19the business of mechanical or body repairs or towing for
20direct compensation of motor vehicles owned and operated by
21other persons.

22(2) Vehicle salvage dealer.--Any person regularly
23engaged in the business of acquiring and dismantling used,
24wrecked, damaged, abandoned or salvage vehicles for the
25purpose of selling the usable parts and selling the remaining
26vehicle hulk materials for recycling or processing.

27(3) Transporter.--Any person regularly engaged in the
28business of transporting new or used vehicles on their own
29wheels, owned by or in possession of a manufacturer or
30dealer.

1(4) Financier or collector-repossessor.--Any person who
2is duly authorized by the Department of Banking to do
3business in this Commonwealth as a financier or collector-
4repossessor and who is regularly engaged in the business of
5financing sales, making loans on the security of vehicles or
6repossessing vehicles which are the subject of installment
7sales contracts as an independent contractor.

8(5) Watercraft trailer dealer.--Any person regularly
9engaged in the business of selling watercraft and trailers
10used exclusively for the transport of the watercraft.

11(6) Automotive detailing.--Any person regularly engaged
12in the business of performing an extremely thorough cleaning,
13polishing and waxing, both interior and exterior, of
14automobiles owned or in the possession of a manufacturer or
15dealer, to produce a show-quality appearance level.

16Section 2. This act shall take effect in 60 days.
