AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further providing for restricted
3activities.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1103(i) of Title 65 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1103. Restricted activities.

10(i) Former executive-level employee.--

11(1) No former executive-level State employee may for a
12period of two years from the time that he terminates
13employment with this Commonwealth be employed by, receive
14compensation from, assist or act in a representative capacity
15for a business or corporation that he actively participated
16in recruiting to this Commonwealth or that he actively
17participated in inducing to open a new plant, facility or
18branch in this Commonwealth or that he actively participated

1in inducing to expand an existent plant or facility within
2this Commonwealth, provided that the above prohibition shall
3be invoked only when the recruitment or inducement is
4accomplished by a grant or loan of money or a promise of a
5grant or loan of money from the Commonwealth to the business
6or corporation recruited or induced to expand.

7(2) No former executive-level State employee having
8responsibilities related to the awarding of contracts by a
9State agency, the development of policies or requirements
10relating to a contract, the negotiation of a contract or
11other participation in the development or award of a contract
12shall do any of the following until at least two years
13subsequent to termination of employment:

14(i) Seek or accept employment with an entity that
15has entered into or intends to enter into a contract with
16that State agency.

17(ii) Represent, before an agency or the Governor's
18Office, a person that has entered into or intends to
19enter into a contract with the State agency with which
20the former executive-level State employee was associated.

21(3) No employee of a person who has a contract with a
22State agency and who becomes an executive-level employee of a
23State agency may participate in the award or negotiation of a
24contract or the development or implementation of requirements
25relating to a contract with the executive-level's former
26employee.

28Section 2. This act shall take effect in 60 days.
