AN ACT

 

1Amending Title 20 (Decedents, Estates and Fiduciaries) of the
2Pennsylvania Consolidated Statutes, in express anatomical
3gifts, further providing for use of driver's license or
4identification card to indicate organ or tissue donation.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 8619(a) of Title 20 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 8619. Use of driver's license or identification card to
10indicate organ or tissue donation.

11(a) General rule.--[Beginning as soon as practicable, but no
12later than January 1, 1995, or one year following the effective
13date of this section, whichever is later, the] The Department of
14Transportation shall [redesign] modify the driver's license and
15identification card application system to [process requests for
16information regarding consent of the individual to organ or
17tissue donation.] advise all individuals that at the time of 
18applying for or renewing a driver's license or identification 
19card, the individual shall be deemed to have consented to
 

1anatomical donation of his or her organs and tissue upon 
2determination of the individual's legal death, unless the 
3individual expressly elects not to be an organ and tissue donor. 
4The following instruction and question shall be [asked:

5Do you wish to have the organ donor designation printed
6on your driver's license?

7Only an affirmative response of an individual]

8provided on both the application for a driver's license or
9identification card and on the organ donor designation at a
10photo center:

11Pennsylvania strongly supports organ and tissue donation
12because of its life-saving and life-enhancing
13opportunities. You are automatically deemed to have
14consented to being an organ and tissue donor and this
15designation will appear on your driver's license or
16identification card. If you do not want to be considered
17an organ and tissue donor, you must elect to not be
18included on the organ donor registry by inserting your
19initials on the line below.

20______ At this time, I do not wish to be included on the
21organ donor registry.

22Unless an individual responds that the individual does not want 
23to be considered a possible organ donor, the words "organ donor"
24shall be noted on the front of the driver's license or
25identification card [and shall clearly indicate the individual's
26intent to donate his organs or tissue]. A notation on an
27individual's driver's license or identification card that he
28intends to donate his organs or tissue is deemed sufficient to
29satisfy all requirements for consent to organ or tissue
30donation.

1Section 2. This act shall take effect in 60 days.
