AN ACT

 

1Amending Titles 24 (Education) and 71 (State Government) of the
2Pennsylvania Consolidated Statutes, further providing for
3Public School Employees' Retirement Board and for the State
4Employees' Retirement Board.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 8501(e) of Title 24 of the Pennsylvania
8Consolidated Statutes is amended and the section is amended by
9adding a subsection to read:

10§ 8501. Public School Employees' Retirement Board.

12(e) Corporate power [and legal advisor].--For the purposes
13of this part, the board shall possess the power and privileges
14of a corporation. [The Attorney General of the Commonwealth
15shall be the legal advisor of the board.]

16(f) Legal advisor.-–Notwithstanding any other provision of
17law, the board shall employ individuals as necessary to be legal
18advisors to the board. A legal advisor employed by the board

1shall serve at the pleasure of the board and shall be considered
2a State employee for the purposes of this part. For the purposes
3of this subsection, the board shall not be considered an
4executive or independent agency under the act of October 15,
51980 (P.L.950, No.164), known as the Commonwealth Attorneys Act.

6Section 2. Section 5901(e) of Title 71 is amended and the
7section is amended by adding a subsection to read:

8§ 5901. The State Employees' Retirement Board.
