AN ACT

 

1Amending Title 51 (Military Affairs) of the Pennsylvania
2Consolidated Statutes, in military leave of absence, further
3providing for educational leave of absence.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 7313 of Title 51 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 7313. Educational leave of absence.

9(a) General rule.--Whenever any member of the Pennsylvania
10National Guard or other reserve component of the armed forces of
11the United States shall be called or ordered to active duty,
12other than active duty for training, including, in the case of
13members of the Pennsylvania National Guard, active State duty,
14the educational institution in which the member is enrolled
15shall grant the member or the member's spouse a military leave
16of absence from [their] the member's education. Members and 
17spouses on military leave of absence from their educational

1institution shall be entitled, upon the member's release from
2military duty, to be restored to the educational status they had
3attained prior to the member's being ordered to military duty
4without loss of academic credits earned, scholarships or grants
5awarded or tuition and other fees paid prior to the commencement
6of the military duty.

7(b) Change in degree requirements.--If the requirements to 
8obtain a degree change while a member is on active duty with the 
9Pennsylvania National Guard or the reserve components of the 
10armed forces of the United States, the member shall have the 
11right to pursue the member's academic degree under the new 
12requirements or the requirements in place prior to the member's 
13call or order to active duty, other than active duty for 
14training, including, in the case of a member of the Pennsylvania 
15National Guard, active State duty.

16(c) Notice of rights.--Upon the return of a member of the
17Pennsylvania National Guard or the reserve components of the
18armed forces of the United States from active duty to an
19educational institution, the educational institution shall
20advise the member in writing or through electronic mail of the
21member's rights under this section.

22(d) Refunds or credits of tuition and fees paid.--It shall
23be the duty of the educational institution to refund tuition or
24fees paid or to credit the tuition and fees to the next semester
25or term after the termination of the educational military leave
26of absence at the option of the student.

27Section 2. This act shall take effect in 60 days.
