1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for grading.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 3803(a) of Title 75 of the Pennsylvania
6Consolidated Statutes is amended to read:

7§ 3803. Grading.

8(a) Basic offenses.--[Notwithstanding the provisions of]
9Except as provided in subsection (b):

10(1) An individual who violates section 3802(a) (relating
11to driving under influence of alcohol or controlled
12substance) and has no more than one prior offense commits a
13misdemeanor for which the individual may be sentenced to a
14term of imprisonment of not more than six months and to pay a
15fine under section 3804 (relating to penalties).

16(2) An individual who violates section 3802(a) and has
17more than one prior offense commits a misdemeanor of the
18second degree.
