AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for school police
6officers.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 778(f) of the act of March 10, 1949
10(P.L.30, No.14), known as the Public School Code of 1949,
11amended June 25, 1997 (P.L.297, No.30), is amended and the
12section is amended by adding a subsection to read:

13Section 778. School Police Officers.--* * *

14(f) School districts and municipalities may enter into
15cooperative police service agreements pursuant to 42 Pa.C.S. §
168953(e) (relating to Statewide municipal police jurisdiction)
17and 53 Pa.C.S. § 2303 (relating to intergovernmental cooperation 
18authorized) to authorize the exercise of concurrent jurisdiction
19with local law enforcement within the municipality where the

1school or school district is located or within the municipality
2in which a school event or activity will take place.

3(f.1) <-A school district and municipality may enter into a
4cooperative police service agreement pursuant to 42 Pa.C.S. §
58953(e) and 53 Pa.C.S. § 2303 to authorize the exercise of
6concurrent jurisdiction with local law enforcement outside the
7municipality where the school or school district is located or
8outside the municipality in which a school event or activity
9will take place if the school district is located within a
10municipality where police services are furnished by the
11Pennsylvania State Police. <-(1) If a school is located within a
12municipality where no municipal police department exists, the
13school district may enter into a cooperative police service
14agreement pursuant to 42 Pa.C.S. § 8953(e) and 53 Pa.C.S. § 2303
15with a municipality providing full-time police coverage that is
16located adjacent to the school. At least thirty (30) days prior
17to executing a cooperative police service agreement under this
18subsection, the school district shall provide written notice of
19its intent to enter into the agreement to the municipality where
20the school is located. A copy of the executed agreement shall be
21provided to the commanding officer of the Pennsylvania State
22Police installation that provides primary police services to the
23municipality where the school is located.

24(2) A cooperative police service agreement entered into
25under this subsection shall only pertain to actions taken on
26school property pursuant to the agreement and shall not affect
27the jurisdiction of the Pennsylvania State Police.
