AN ACT

 

1Amending the act of July 23, 1970 (P.L.563, No.195), entitled
2"An act establishing rights in public employes to organize
3and bargain collectively through selected representatives;
4defining public employes to include employes of nonprofit
5organizations and institutions; providing compulsory
6mediation and fact-finding, for collective bargaining
7impasses; providing arbitration for certain public employes
8for collective bargaining impasses; defining the scope of
9collective bargaining; establishing unfair employe and
10employer practices; prohibiting strikes for certain public
11employes; permitting strikes under limited conditions;
12providing penalties for violations; and establishing
13procedures for implementation," further providing for
14employee organizations and penalties.

15The General Assembly of the Commonwealth of Pennsylvania
16hereby enacts as follows:

17Section 1. Sections 1701 and 1901 of the act of July 23,
181970 (P.L.563, No.195), known as the Public Employe Relations
19Act, are amended to read:

20Section 1701. No employe organization shall make any
21contribution out of the funds of the employe organization either
22directly or indirectly to any political party or organization or
23in support of any political candidate for public office.

24The board shall establish such rules and regulations as it

1may find necessary to prevent the circumvention or evasion of
2the provisions of this section.

3If an employe organization has made contributions in
4violation of this section it shall file with the board a report
5or affidavit evidencing such contributions within ninety days of
6the end of its fiscal year. Such report or affidavit shall be
7signed by its president and treasurer or corresponding
8principals.

9Any employe organization which violates the provisions of
10this section or fails to file any required report or affidavit
11or files a false report or affidavit shall be subject to a fine
12of not more than [two thousand dollars ($2,000)] four thousand 
13dollars ($4,000).

14Any person who wilfully violates this section, or who makes a
15false statement knowing it to be false, or who knowingly fails
16to disclose a material fact shall be fined not more than [one
17thousand dollars ($1,000)] two thousand dollars ($2,000) or
18imprisoned for not more than thirty days or both. Each
19individual required to sign affidavits or reports under this
20section shall be personally responsible for filing such report
21or affidavit and for any statement contained therein he knows to
22be false.

23Nothing herein shall be deemed to prohibit voluntary
24contributions by individuals to political parties or candidates.

25Section 1901. Any person who shall wilfully resist, prevent,
26impede or interfere with any member of the board, or any of its
27agents, in the performance of duties pursuant to this act, shall
28be guilty of a misdemeanor, and, upon conviction thereof, shall
29be sentenced to pay a fine of not more than [five thousand
30dollars ($5,000)] ten thousand dollars ($10,000), or by

1imprisonment for not more than one year, or both.

2Section 2. This act shall take effect immediately.
