AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in preliminary provisions, further
6providing for Keystone Exams; and, in State Board of
7Education, further providing for reports and recommendations.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 121 of the act of March 10, 1949 (P.L.30,
11No.14), known as the Public School Code of 1949, added June 30,
122012 (P.L.684, No.82), is amended to read:

13Section 121. Keystone Exams.--(a) Subject to annual
14appropriation, not later than the 2020-2021 school year, the
15Department of Education shall develop and implement Keystone
16Exams in the following subjects: algebra I, literature, biology,
17English composition, algebra II, geometry, United States
18history, chemistry, civics and government and world history. The
19State Board of Education shall promulgate regulations, subject
20to the act of June 25, 1982 (P.L.633, No.181), known as the

1"Regulatory Review Act," necessary to implement this section.

2(b) In addition to any requirements on the State Board of
3Education under the "Regulatory Review Act", on the same date
4that pursuant to the "Regulatory Review Act" the State Board of
5Education submits a proposed regulation for or related to the
6implementation of Keystone Exams under this section to the
7Legislative Reference Bureau for publication of notice of
8proposed rulemaking in the Pennsylvania Bulletin as required by
9the act of July 31, 1968 (P.L.769, No.240), referred to as the
10Commonwealth Documents Law, and thereafter on the same date it
11submits the text of the final-form regulation to the Independent
12Regulatory Review Commission, it shall submit to the chairman
13and minority chairman of the Education Committee of the Senate
14and the chairman and minority chairman of the Education
15Committee of the House of Representatives a detailed fiscal
16impact statement that the proposed or final-form regulation will
17have on the Commonwealth, the communities, the school districts
18and, if applicable, private and private religious schools. The
19detailed fiscal impact statement shall include a comprehensive
20fiscal note of all direct and indirect costs whether incurred in
21preparation of the proposed or final-form regulation or which
22will be required as a result of the promulgation of the
23regulation to its best dollar estimate. The State Board of
24Education may include narrative statements to accompany its best
25dollar estimate, but may not do so in lieu of detailed best
26estimated dollar amounts.

27Section 2. Section 2605-B of the act is amended by adding a
28subsection to read:

29Section 2605-B. Reports and recommendations.--* * *

30(c) Anytime the board submits to the Independent Regulatory

1Review Commission a proposed or final-form regulation for
2processing under the act of June 25, 1982 (P.L.633, No.181),
3known as the "Regulatory Review Act", the board shall submit to
4the chairman and minority chairman of the Education Committee of
5the Senate and the chairman and minority chairman of the
6Education Committee of the House of Representatives on the same
7date a detailed fiscal impact statement that the proposed or
8final-form regulation will have on the Commonwealth, the
9communities, the school districts and, if applicable, private
10and private religious schools. The detailed fiscal impact
11statement shall include a comprehensive fiscal note of all
12direct and indirect costs whether incurred in preparation of the
13proposed or final-form regulation or which will be required as a
14result of the promulgation of the regulation to its best dollar
15estimate. The board may include narrative statements to
16accompany its best dollar estimate, but may not do so in lieu of
17detailed best estimated dollar amounts.

18Section 3. This act shall take effect in 60 days.
