AN ACT

 

1Amending Title 30 (Fish) of the Pennsylvania Consolidated
2Statutes, further providing for disabled veterans and former
3prisoners of war.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2707 of Title 30 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 2707. Disabled veterans and former prisoners of war.

9(a) General rule for disabled veterans.--

10(1) Any disabled veteran who has a disability incurred
11in any war or armed conflict which consists of the loss of
12one or more limbs, or the loss of use of one or more limbs,
13or total blindness, or who is 100% disabled as certified by
14the United States Department of Veterans Affairs, and who
15meets the qualifications of section 2701 (relating to

1resident fishing licenses), shall be issued a free resident
2fishing license upon application to the commission or a
3county treasurer. An application submitted by a disabled
4veteran shall, in addition to any information required under
5section 2701, contain a statement that the applicant is a war
6or armed conflict veteran and that the qualifying disability
7was service incurred. The issuing agent or the commission may
8require the production of the discharge papers of the
9applicant.

10(2) Any disabled veteran who <-is eligible for disability
11compensation as determined <-has a disability incurred in any
12war or armed conflict and possesses a disability rating
13between 60% and 99% as certified by the United States
14Department of Veterans Affairs and who meets the
15qualifications of section 2701 shall be issued a resident
16fishing license at the cost of $1 upon application to the
17commission or a county treasurer. An application submitted by
18a disabled veteran shall, in addition to any information
19required under section 2701, contain a statement that the
20applicant is a war or armed conflict veteran and that the
21qualifying disability was service incurred. The issuing agent
22or the commission may require the production of the discharge
23papers of the applicant.

24(a.1) General rule for former prisoners of war.--

25(1) A former prisoner of war who meets the
26qualifications of section 2701 shall be issued a resident
27fishing license at the cost of $1 upon application to the
28commission or a county treasurer. An application submitted by
29a former prisoner of war shall, in addition to any
30information required under section 2701, contain a statement

1that the applicant is a former prisoner of war.

2(2)  As used in this subsection, the term "former
3prisoner of war" means an individual who was imprisoned by
4enemy forces while in the service of the armed forces of the
5United States as certified by the appropriate branch of the
6armed forces of the United States.

7(b) Lifetime licenses.--

8(1) If a disabled veteran who qualifies for issuance of
9a free resident fishing license under subsection [(a)] (a)(1)
10presents documentation to show that the qualifying disability
11is permanent, the commission or county treasurer shall issue
12a disabled veteran lifetime fishing license.

13(2) A former prisoner of war who meets the
14qualifications of section 2701(b) shall be issued a senior
15resident lifetime fishing license at the cost of $1 upon
16application to the commission or a county treasurer.

17(c) Home rule and optional plan counties.--In a county where
18there is no county treasurer by virtue of a home rule charter or
19optional plan of government, the county official who performs
20the functions of a county treasurer and who has been designated
21an issuing agent by the commission shall issue free and reduced 
22fee resident fishing licenses to disabled veterans and reduced
23fee resident fishing licenses to former prisoners of war under
24this section.

25Section 2. This act shall take effect in 60 days.
