AN ACT

 

1Amending Title 30 (Fish) of the Pennsylvania Consolidated
2Statutes, further providing for disabled veterans and former
3prisoners of war.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2707 of Title 30 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 2707. Disabled veterans and former prisoners of war.

9(a) General rule for disabled veterans.--

10(1) Any disabled veteran who has a disability incurred
11in any war or armed conflict which consists of the loss of
12one or more limbs, or the loss of use of one or more limbs,
13or total blindness, or who is 100% disabled as certified by
14the United States Department of Veterans Affairs, and who
15meets the qualifications of section 2701 (relating to
16resident fishing licenses), shall be issued a free resident

1fishing license upon application to the commission or a
2county treasurer. An application submitted by a disabled
3veteran shall, in addition to any information required under
4section 2701, contain a statement that the applicant is a war
5or armed conflict veteran and that the qualifying disability
6was service incurred. The issuing agent or the commission may
7require the production of the discharge papers of the
8applicant.

9(2) Any disabled veteran who is eligible for disability
10compensation as determined by the United States Department of
11Veterans Affairs and who meets the qualifications of section
122701 shall be issued a resident fishing license at the cost
13of $1 upon application to the commission or a county
14treasurer. An application submitted by a disabled veteran
15shall, in addition to any information required under section
162701, contain a statement that the applicant is a war or
17armed conflict veteran and that the qualifying disability was
18service incurred. The issuing agent or the commission may
19require the production of the discharge papers of the
20applicant.

21(a.1) General rule for former prisoners of war.--

22(1) A former prisoner of war who meets the
23qualifications of section 2701 shall be issued a resident
24fishing license at the cost of $1 upon application to the
25commission or a county treasurer. An application submitted by
26a former prisoner of war shall, in addition to any
27information required under section 2701, contain a statement
28that the applicant is a former prisoner of war.

29(2)  As used in this subsection, the term "former
30prisoner of war" means an individual who was imprisoned by

1enemy forces while in the service of the armed forces of the
2United States as certified by the appropriate branch of the
3armed forces of the United States.

4(b) Lifetime licenses.--

5(1) If a disabled veteran who qualifies for issuance of
6a free resident fishing license under subsection [(a)] (a)(1)
7presents documentation to show that the qualifying disability
8is permanent, the commission or county treasurer shall issue
9a disabled veteran lifetime fishing license.

10(2) A former prisoner of war who meets the
11qualifications of section 2701(b) shall be issued a senior
12resident lifetime fishing license at the cost of $1 upon
13application to the commission or a county treasurer.

14(c) Home rule and optional plan counties.--In a county where
15there is no county treasurer by virtue of a home rule charter or
16optional plan of government, the county official who performs
17the functions of a county treasurer and who has been designated
18an issuing agent by the commission shall issue free and reduced 
<-19fee resident fishing licenses to disabled veterans and reduced
20fee resident fishing licenses to former prisoners of war under
21this section.

22Section 2. This act shall take effect in 60 days.
