AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, in hunting and furtaking licenses, further
3providing for resident license and fee exemptions and for
4license costs and fees.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 2706(b) of Title 34 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 2706. Resident license and fee exemptions.

11(b) Disabled veterans.--

12(1) Any resident disabled veteran of any war or armed
13conflict whose physical disability consists of the loss of
14one or more limbs, or the loss of the use of one or more
15limbs, or whose physical disability is considered total and
16who meets all other qualifications of this title and is
17otherwise mentally and physically fit, shall be issued a

1regular hunting or furtaking license upon application to any
2county treasurer, without the payment of the license cost, if
3that person is domiciled in this Commonwealth. The following 
4provisions shall apply:

5[(2)] (i) The application for the issuance of this
6license shall, in addition to the other information required
7by the director, contain a statement that the applicant is a
8war or armed conflict veteran and that his physical
9disability was service incurred.

10[(3)] (ii) The applicant shall produce the applicant's
11discharge papers and a Department of Veterans Affairs
12disability certification to the effect that the applicant
13suffers total physical disability.

14[(4)] (iii) If a disabled veteran who qualifies for
15issuance of a license under this [subsection] paragraph 
16presents documentation to show that the qualifying disability
17is permanent, the county treasurer shall issue the disabled
18veteran a lifetime hunting or furtaking license.

19[(5)] (iv) In a county where there is no county
20treasurer by virtue of a home rule charter or optional plan
21of government, the county official who performs the functions
22of a county treasurer and who has been designated an issuing
23agent by the commission shall issue licenses under this
24[subsection] paragraph.

25(2) Any resident disabled veteran of any war or armed
26conflict who is eligible for disability compensation as
27determined by the United States Department of Veterans
28Affairs and who meets all other qualifications of this title
29and is otherwise mentally and physically fit shall be issued
30a regular hunting or furtaking license at the cost of $1 upon

1application to any county treasurer, if that person is
2domiciled in this Commonwealth. The following provisions
3shall apply:

4(i) The application for the issuance of this license
5shall, in addition to the other information required by
6the director, contain a statement that the applicant is a
7war or armed conflict veteran and that his physical
8disability was service incurred.

9(ii) The applicant shall produce the applicant's
10discharge papers and a Department of Veteran Affairs
11disability certification.

12(iii) In a county where there is no county treasurer
13by virtue of a home rule charter or optional plan of
14government, the county official who performs the
15functions of a county treasurer and who has been
16designated an issuing agent by the commission shall issue
17licenses under this paragraph.

19Section 2. Section 2709(a)(17) of Title 34 is amended and
20the subsection is amended by adding a paragraph to read:

21§ 2709. License costs and fees.

22(a) License costs.--Any person who qualifies under the
23provisions of this chapter shall be issued the applicable
24license upon payment of the following costs and the issuing
25agent's fee:

27(17) Resident disabled veteran hunting or furtaker under
28section [2706(b)] 2706(b)(1) (relating to disabled veterans)
29- no cost.

30(17.1) Resident disabled veteran hunting or furtaker

1under section 2706(b)(2) - $1.

3Section 3. This act shall take effect in 60 days.
