AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, further providing for resident license and fee
3exemptions.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2706(b) of Title 34 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 2706. Resident license and fee exemptions.

10(b) Disabled veterans.--

11(1) Any resident disabled veteran [of<-] who has a 
12disability incurred in any war or armed conflict <-[whose
13physical disability<-] which consists of the loss of one or
14more limbs, or the loss of the use of one or more limbs, or
15[whose physical disability is considered total] WHO IS 100%<- 
16DISABLED AS CERTIFIED BY THE DEPARTMENT OF VETERANS AFFAIRS,

1and who meets all other qualifications of this title and is
2otherwise mentally and physically fit, shall be issued a <-free
3regular hunting or furtaking license upon application to
<-4[any<-] the commission or a county treasurer<-[, without the
5payment of the license cost, if that person is domiciled in
6this Commonwealth<-].

7(1.1) Any disabled veteran who <-is eligible for
8disability compensation as determined <-has a disability
9incurred in any war or armed conflict and possesses a
10disability rating between 60% and 99% as certified by the
11United States Department of Veterans Affairs and who meets
12all other qualifications of this act and is otherwise
13mentally and physically fit, shall be issued a resident
14hunting <-or furtaking license at the cost of $1 upon
15application to <-any the commission or a county treasurer.

16(2) The application for the issuance of [this<-] a license 
<-17under paragraph (1) or (1.1) shall, in addition to the other
18information required by the [director<-] commission, contain a
19statement that the applicant is a war or armed conflict
20veteran and that [his physical<-] the qualifying disability was
21service incurred.

22(3) The <-[applicant shall produce the applicant's
23discharge papers and a Department of Veterans Affairs
24disability certification to the effect that the applicant
<-25suffers total physical disability or is eligible for 
26disability compensation as determined by the United States 
27Department of Veterans Affairs. <-suffers total physical 
28disability] issuing agent or the commission may require the 
29production of the discharge papers of the applicant.

30(4) If a disabled veteran who qualifies for issuance of

1a license under [this subsection] paragraph (1) presents
2documentation to show that the qualifying disability is
3permanent, the county treasurer shall issue the disabled
4veteran a lifetime hunting or furtaking license.

5(5) In a county where there is no county treasurer by
6virtue of a home rule charter or optional plan of government,
7the county official who performs the functions of a county
8treasurer and who has been designated an issuing agent by the
9commission shall issue licenses under this subsection.

11Section 2. This act shall take effect in 60 days.
