AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, providing for fee for person with disability
3placard.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1338 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 1338. Person with disability plate and placard.

10(c.3) Fee for disability parking placard.--Upon initial
11renewal or replacement application of any person who meets the
12requirements of this section, accompanied by the fee prescribed
13in this title, the department shall issue a disability parking
14placard as provided in subsection (b), which shall be valid for
15three years and may be renewed for successive three-year
16periods. The department shall phase out existing parking
17placards for persons with disabilities in accordance with the
18dates the placards expire. The renewal of a placard initially

1issued prior to the effective date of this section shall be
2subject to the prescribed fee.

4Section 2. Title 75 is amended by adding a section to read:

5§ 1962. Fee for person with disability parking placard.

6(a) Fee.--The department shall charge $10 for each
7disability parking placard issued or renewed, and $15 for each
8disability parking placard replaced under section 1338 (relating
9to person with disability plate and placard).

10(b) Disposition of fees.--Notwithstanding section 1904
11(relating to collection and disposition of fees and moneys),
12fees collected under this section shall be allocated as follows:

13(1) Five percent to the department for administrative
14costs.

15(2) Ninety-five percent to the Office of Vocational
16Rehabilitation for grants to centers for independent living
17in accordance with the act of December 12, 1994 (P.L.1023,
18No.139), known as the Independent Living Services Act.

19(c) Exemption.--No fee shall be charged under this section
20to any of the following:

21(1) Disabled veterans and their spouses and the
22unmarried surviving spouses of deceased disabled veterans.

23(2) Individuals over 85 years of age.

24Section 3. This act shall take effect June 30, 2013, or
25immediately, whichever is later.
