AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for permit for movement during
3course of manufacture.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

7Section 1. Section 4968(a.1)(3), (a.2)(4) and (b) of Title
875 of the Pennsylvania Consolidated Statutes, amended October
924, 2012 (P.L.1473, No.187), are amended to read:

10§ 4968. Permit for movement during course of manufacture.

11(a.1) General rule.--An annual permit may be issued
12authorizing movement on specified highways of:

14(3) aircraft refueling vehicles or vehicles and
15combinations carrying [raw] milk, raw coal, flat-rolled steel
16coils, steel slabs, hot ingots, a hot box, pulpwood and wood
17chips, raw water or cryogenic liquid which exceed the maximum
18weight specified in Subchapter C while they are in the course

1of manufacture and under contract with or under the direct
2control of the manufacturer, provided that they do not exceed
3the maximum height, width or length specified in Subchapter B
4unless they also qualify under paragraph (1), subject to the
5provisions in subsection (a.2).

6(a.2) Specifications.--

8(4) A combination of vehicles which is hauling [raw]
9milk to or from a manufacturer may be permitted by the
10department and local authorities to move upon highways within
11their respective jurisdictions 24 hours a day, seven days a
12week, except during inclement weather as defined in
13department regulations, if the gross weight does not exceed
1495,000 pounds and the weight of any nonsteering axle does not
15exceed 21,000 pounds. No permit may be issued for this type
16of movement upon an interstate highway. An application to the 
17department for the movement of milk, except for raw milk, 
18must designate the route the applicant requests to use.

20(b) Definitions.--As used in this section, the following
21words and phrases shall have the meanings given to them in this
22subsection:

23"Bulk milk." The term shall mean milk, as defined in section
241 of the act of July 2, 1935 (P.L.589, No.210), referred to as
25the Milk Sanitation Law, which is not transported in packages.

26"Condensed milk" and "evaporated milk." The term shall mean
27manufactured dairy products as defined in section 1 of the Milk
28Sanitation Law, which is not transported in packages.

29"Hot box." Consists of an enclosure consisting of welded
30steel plate chained to a semitrailer with a removable lid lined

1with refraction for purposes of insulation and retention of
2heat.

3"Milk." Any of the following:

4(1) Bulk milk.

5(2) Cream.

6(3) Plain or sweetened evaporated milk.

7(4) Raw milk.

8(5) Skim or whole condensed milk.

9(6) Skimmed milk.

10"Raw milk." Has the meaning given to it in the [act of July
112, 1935 (P.L.589, No.210), referred to as the] Milk Sanitation
12Law.

13Section 2. The General Assembly declares that the amendment
14of 75 Pa.C.S. § 4968(a.2)(4) shall not affect the Department of
15Transportation's requirements regarding the permit for the
16movement of raw milk found at 50A on pages 83 and 84 of the
17Department of Transportation's Publication 31.

18Section 3. This act shall take effect in 60 days.
