AN ACT

 

1Amending the act of June 23, 1931 (P.L.932, No.317), entitled
2"An act relating to cities of the third class; and amending,
3revising, and consolidating the law relating thereto,"
4providing for emergency services reimbursement.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. The act of June 23, 1931 (P.L.932, No.317), known
8as The Third Class City Code, reenacted and amended June 28,
91951 (P.L.662, No.164), is amended by adding a section to read:

10Section 2110.  Emergency Services Reimbursement.--(a)  The
11Commonwealth shall annually reimburse a city for emergency
12services provided by the city at property owned or leased by the
13Commonwealth within the city from the fund established under
14subsection (b). The reimbursement may not be less than five
15million dollars in any fiscal year and shall increase each year
16according to the percentage increase in the Consumer Price Index
17for All Urban Consumers for the Pennsylvania, New Jersey,
18Delaware and Maryland area as officially reported by the United
19States Department of Labor, Bureau of Labor Statistics.

1(b) There is hereby established in the State Treasury a
2special fund to be known as the Third Class City Emergency
3Services Reimbursement Fund. Money in the fund is annually
4appropriated to the city for the purposes authorized under this
5section. The Commonwealth shall transfer one and four-tenths per
6centum of the funds collected as the realty transfer tax under
7Article XI-C of the act of March 4, 1971 (P.L.6, No.2), known as
8the "Tax Reform Code of 1971," from the General Fund into the
9fund.

10(c) Definitions.--As used in this section, the following
11words and phrases shall have the meanings given to them in this
12subsection unless the context clearly indicates otherwise:

13"City," a city of the third class where all of the following
14apply:

15(1) The city has a population of not less than forty
16thousand and not more than fifty-five thousand residents based
17on the most recent Federal decennial census.

18(2)  The city is located in a county of the third class.

19(3)  At least fifteen per centum of the property in the city
20is owned or leased by the Commonwealth.

21"Emergency services," services provided by a fire, ambulance
22or rescue company.

23"Fund," the Third Class City Emergency Services Reimbursement
24Fund.

25Section 2. This act shall take effect in 60 days.
