AN ACT

 

1Amending Titles 18 (Crimes and Offenses) and 75 (Vehicles) of
2the Pennsylvania Consolidated Statutes, further providing for
3the offense of scattering rubbish and for the offense of
4depositing of waste and other material on highway, property
5or waters.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Section 6501(b)(1) and (2) of Title 18 of the
9Pennsylvania Consolidated Statutes are amended to read:

10§ 6501. Scattering rubbish.

12(b) Penalty.--

13(1) A person who violates subsection (a)(1) or (2) is
14guilty of a summary offense for the first offense and upon
15conviction thereof shall be sentenced to pay a fine of not
16less than [$50 nor more than $300] $1,000 or to imprisonment
17for not more than 90 days, or both.

18(2) A person who violates subsection (a)(1) or (2) is
19guilty of a misdemeanor of the third degree for the second

1and subsequent offense and upon conviction thereof shall be
2sentenced to pay a fine of not less than [$300 nor more than]
3$1,000. The person also may be sentenced to imprisonment or
4to performing a community service for a period not to exceed
5one year.

7Section 2. Section 3709(d)(1) of Title 75 is amended to
8read:

9§ 3709. Depositing waste and other material on highway,
10property or waters.

12(d) Penalty.--Any person violating any of the provisions of
13subsection (a) or (b) commits a summary offense and shall, upon
14conviction, be sentenced to either or both of the following:

15(1) To pay [a fine of not more than]:

16(i) [$900] for a violation which occurs in an
17easement purchased under the program established by
18section 14.1 of the act of June 30, 1981 (P.L.128, 
19No.43), known as the Agricultural Area Security Law, a 
20fine of not less than $1,000;

21(ii) [$600] for a violation which occurs in an
22agricultural security area as defined in section 3 of the
23Agricultural Area Security Law, a fine of not less than 
24$1,000; or

25(iii) [$300] for a violation which occurs anywhere
26else, a fine of not less than $1,000.

28Section 3. This act shall take effect in six months.
