AN ACT

 

1Amending Titles 53 (Municipalities Generally) and 75 (Vehicles)
2of the Pennsylvania Consolidated Statutes, providing for the
3Municipal Police Recruitment and Retention Program and for
4law enforcement enhancement surcharge.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Title 53 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 2172. Municipal Police Recruitment and Retention Program.

10(a) Establishment.--There is hereby established in the State
11Treasury the Municipal Police Recruitment and Retention Program
12Fund as a special, nonlapsing fund. Moneys in the fund shall be
13expended for the purposes set forth in this section.

14(b) Administration.--The commission shall administer the
15fund and make grants from the fund for recruitment and retention
16of a municipality's part-time police force in accordance with
17this section.

18(c) Purpose of grants.--Grants shall be for the purpose of
19hiring and retaining part-time police officers in a municipality

1and shall be used to pay a portion of the salary of a part-time
2police officer. Grants shall not exceed $5,000 per police
3officer position and shall be used to supplement the part-time
4police officer's salary paid by the municipality up to a maximum
5of $15 per hour of pay, not to exceed 85% of a full-time base
6salary for a police officer in the municipality. The rate shall
7be calculated based on average salaries for 2013 as adjusted
8annually by the Consumer Price Index for the metropolitan area
9in which the municipality is located.

10(d) Other funds.--In addition to the moneys available in the
11fund, any appropriation for municipal police officer training
12that remains as part of the commission prior to lapsing shall be
13deposited in the fund beginning with the current fiscal year,
14for the purposes contained in this section.

15(e) Regulations.--The commission shall promulgate rules and
16regulations to implement and administer the provisions of this
17section within 90 days of the effective date of this section.

18(f) Definitions.--As used in this section, the following
19words and phrases shall have the meaning given to them in this
20subsection unless the context clearly indicates otherwise:

21"Fund." The Municipal Police Recruitment and Retention
22Program Fund established under subsection (a).

23"Municipality." A city of the third class, borough, township
24of the first class or township of the second class that provides
25local police services through a municipal police department,
26participation in a regional police department or contracts with
27other municipal or regional police.

28Section 2. Title 75 is amended by adding a section to read:

29§ 6508. Law enforcement enhancement surcharge.

30(a) Levy and imposition.--In addition to any fines, fees or

1penalties levied or imposed as provided by law under this title
2or any other statute, a surcharge shall be levied for
3disposition in accordance with subsection (b). Upon conviction
4for any violation of the provisions of this title or other
5statute of this Commonwealth, or regulations promulgated under
6this title, which is a traffic violation, exclusive of parking
7offenses, a surcharge of $10 shall be levied.

8(b) Disposition.--Notwithstanding the provisions of 42
9Pa.C.S. §§ 3571 (relating to Commonwealth portion of fines,
10etc.) and 3573 (relating to municipal corporation portion of
11fines, etc.) all surcharges levied and collected under
12subsection (a) by any division of the unified judicial system
13existing under section 1 of Article V of the Constitution of
14Pennsylvania and 42 Pa.C.S. § 301 (relating to unified judicial
15system) shall be remitted to the Commonwealth for deposit in the
16Municipal Police Recruitment and Retention Program Fund,
17established under 53 Pa.C.S. § 2172 (relating to Municipal
18Police Recruitment and Retention Program), for the purpose of
19recruiting and retaining municipal police officers.

20Section 3. This act shall take effect in 60 days.
