1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in registration of vehicles, further providing for
3department vehicle registration records.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1316 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1316. Department records.

9(a) General rule.--The department shall maintain suitable
10records in a manner permitting identification of vehicles and
11owners, including:

12(1) All registrations and transfers of registrations
13issued.

14(2) All registrations and transfers of registrations
15denied and reasons for denial. Registrations and transfers
16returned for correction of errors or omissions need not be
17recorded.

18(b) Confidential registration.--

1(1) Subject to paragraph (3), a confidential
2registration of a vehicle as to which the records of the
3department are available only as prescribed by this section
4may be issued to:

5(i) A governmental law enforcement agency for a
6vehicle used to any extent for undercover or surveillance
7purposes.

8(ii) Commonwealth departments and other agencies for
9vehicles assigned to department secretaries and deputy
10secretaries and heads of other agencies.

11(iii) A judge or magisterial district judge.

12(iv) A district attorney.

13(2) Application for a confidential registration shall be
14made on a form furnished by the department.

15(3) Information concerning the identity of the
16registrant of a confidential registration shall be provided
17only upon written request of the registrant or a law
18enforcement agency.

19(4) Upon receipt of a request for information concerning
20a confidential registration from any person or entity other
21than the registrant or a law enforcement agency, the
22department shall inform the requester that the identity of
23the registrant is confidential and shall notify the
24registrant of the identity of the requester.

25Section 2. This act shall take effect in 180 days.
